These terms govern the use of the Equimergency app and its related services.

§ 1 Scope

These general terms and conditions apply to the use of the Equimergency app and its related services provided by Constantin Alexander Vennekel, Zwingenbergstr. 108, 47802 Krefeld, Germany, Germany (hereinafter “Equimergency”).

Equimergency operates a digital platform that connects horse owners with emergency veterinarians. Equimergency does not itself provide veterinary services.

§ 2 Eligibility and registration

Using the app requires registration. You confirm that you are at least 18 years old and that the information you provide is accurate.

Veterinarians are verified before activation. Verification requires the license to practise (Approbationsurkunde) or an equivalent credential. Equimergency reserves the right to refuse or revoke verification.

§ 3 Services

3.1 For horse owners

Equimergency enables horse owners to find and immediately contact an available veterinarian nearby in an emergency. For every emergency request, the service fee of currently €15.00 is pre-authorized as a hold on the payment method on file. It is only charged on a successful mediation, namely when the veterinarian departs — even if the horse owner withdraws the request afterwards; otherwise the hold is released. If the hold cannot be placed, the service fee is charged or invoiced afterwards on a successful mediation. No further fees apply (§ 4). The veterinary treatment itself is billed to the horse owner separately and directly by the veterinarian.

3.2 For veterinarians

Using the platform is currently free of charge for veterinarians: there is no subscription, no base fee and no joining fee. The first three cases mediated through Equimergency are free in any event. For the period thereafter, Equimergency reserves the right to introduce terms for veterinarians; such terms will be agreed separately in advance and announced in accordance with § 7. Veterinarians decide themselves when they are available and may decline requests.

§ 4 Payment terms

Payments to Equimergency are processed via Stripe. Equimergency charges the horse owner — and only the horse owner — a flat service fee of currently €15.00 per successfully mediated emergency — held at the time of the request, charged when the veterinarian departs, in addition to the veterinarian's own invoice. Horses with a valid Notfallpass or stable subscription are exempt from the service fee. Equimergency never receives a percentage share of the veterinary invoice and no commission that depends on the amount of the treatment costs.

The remuneration for the veterinary service is agreed solely between veterinarian and horse owner and settled directly between them; Equimergency is not involved in that settlement.

If no mediation takes place (no veterinarian accepts the request within 30 minutes), the pre-authorization is released immediately; no service fee is charged in that case.

§ 5 Liability

Equimergency is not liable for the quality, completeness, or correctness of veterinary treatment. Liability is limited to the matching service.

Equimergency is not liable for damages caused by the unavailability of veterinarians, technical failures, or force majeure. Where liability exists, it is limited to the amount the user has paid to Equimergency in the preceding 12 months.

§ 6 Termination and account deletion

There is currently no paid subscription for veterinarians that would need to be cancelled; participation can be ended at any time. User accounts can be deleted in the app under Settings → Account → Delete account. All personal data is deleted within 30 days unless statutory retention obligations apply.

§ 7 Changes to these terms

Equimergency reserves the right to amend these terms. Users are informed of material changes by email 30 days in advance.

§ 8 Governing law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For disputes with merchants, the place of jurisdiction is Krefeld.
